Definitions

1. “Act” as used in this By-Law shall mean Medical Act, 2005.

“College” as used in this By-Law shall mean the College of Physicians and Surgeons of Newfoundland and Labrador.

“Registers” as used in this By-Law shall mean one or more, as the context requires, of the Medical Register, the Specialists’ Register, and the Educational Register as defined under the Act, the list of provisional licence holders to be maintained pursuant to subsection 23(8) of the Act, and the Corporate Register to be maintained under section 27 of the Act.

Medical Register

2. The Medical Register to be maintained pursuant to section 15 of the Act shall be known as the Newfoundland and Labrador Medical Register, and shall have entered on it the College’s information regarding the following:

(a) the full name of the medical practitioner, including first name, surname, and middle name or middle initial;

(b) the practice address and practice telephone number;

(c) faculty or school of medicine attended and graduation year;

(d) Canadian certifications, the Licentiate of the Medical Council of Canada, and College-recognized international specialist qualifications;

(e) licence number;

(f) practice area(s);

(g) licence status; and

(h) licence or practice conditions and restrictions.

Specialist Register

3. The Specialist Register to be maintained pursuant to Section 17 of the Act shall be known as the Specialists’ Register of the College, and shall have entered on it the College’s information regarding the following:

(a) the full name of the medical practitioner, including first name, surname, and middle name or middle initial;

(b) the practice address and practice telephone number;

(c) faculty or school of medicine attended and graduation year;

(d) Canadian specialist certifications;

(e) licence number;

(f) practice area(s);

(g) licence status; and

(h) licence or practice conditions and restrictions.

Educational Register

4. The Educational Register to be maintained pursuant to Section 18 of the Act shall be known as the Educational Register of the College, and shall have entered on it the College’s information regarding the following:

(a) the full name of the registrant, including first name, surname, and middle name or middle initial;

(b) faculty or school of medicine attended and graduation status;

(c) Canadian certifications, the Licentiate of the Medical Council of Canada, and College-recognized international specialist qualifications;

(d) registration number;

(e) practice area(s) of training;

(f) registration status; and

(g) registration conditions and restrictions.

List of Provisional Licensees

5. The list of provisional licensees to be maintained pursuant to Section 23 of the Act shall be known as the Provisional List of the College and shall have entered on it the College’s information regarding the following:

(a) the full name of the practitioner, including first name, surname, and middle name or middle initial;

(b) the practice address and practice telephone number;

(c) faculty or school of medicine attended and graduation year;

(d) Canadian certifications, the Licentiate of the Medical Council of Canada, and College-recognized international specialist qualifications;

(e) licence number;

(f) practice area(s);

(g) licence status;

(h) any licence or practice conditions and restrictions; and

(i) sponsor of the medical practitioner.

Corporate Register

6. The Corporate Register to be maintained pursuant to Section 27 of the Act shall be known as the Corporate Register of the College, and shall have entered on it the College’s information regarding the following:

(a) corporate name of the professional medical corporation;

(b) practice address and practice telephone number of the corporation;

(c) the names and licence numbers of the directors of the corporation;

(d) the names and licence numbers, practice addresses, and practice areas of all medical practitioners who will be practicing medicine as employees of or on behalf of the corporation;

(e) the names and licence numbers of all the medical practitioners who are shareholders of the corporation;

(f) licence number of the corporation;

(g) licence status of the corporation; and

(h) licence or practice conditions and restrictions on the corporation.

Maintenance of the Registers

7. (i) The Registers shall be maintained by the Registrar, at the offices of the College, and shall be made available for inspection by the public during regular business hours upon reasonable notice.

(ii) The Registrar may also maintain an electronic version of one or more of the Registers on the College’s website.

(iii) The Registrar may charge a fee for inspection of a Register, not to exceed the maximum fee to be set annually by the Council.

Other uses of information on the Registers

8. The Registrar may, with the approval of Council, make information entered on the Registers available to public bodies, as defined under the Access to Information and Protection of Privacy Act, SNL 2002, and to such other bodies or agencies as the Council may determine, where the Council is of the opinion that such provision of the information would serve the public interest.

Personal information

9. Notwithstanding any other provision of this By-Law, excepting where a condition or restriction on the registration, licence or practice has been ordered pursuant to section 43 or 44 of the Act, the Council may determine that a condition or restriction on registration, licence or practice should not be entered on a Register, where the Council considers that the desirability of protecting the medical practitioner or registrant against public disclosure of a personal matter outweighs the desirability of public disclosure.
