Advisory - Privacy, Confidentiality, and Disclosure of Patient Health Information

The Personal Health Information Act (PHIA) sets out rules for the collection, use and disclosure of personal health information. It includes rules that provide individuals with the right to access their own personal health information.

Personal health information is identifiable information about physical and mental health, family history, organ donation, insurance coverage, and prescriptions.

PHIA applies to all physicians.  That includes retired physicians who retain patient files and to any individual or company who may be holding those records on behalf of a retired physician.

To help meet physicians and other health professionals meet PHIA requirements, the Department of Health and Community Services posted information on the department’s website that will help custodians to understand their obligations under the Act and develop policies and procedures within their own practice for handling personal health information in compliance with the Act.

PHIA Education Program and Medical Licensing

Physicians practicing medicine in Newfoundland and Labrador are expected to complete the Personal Health Information Act (PHIA) online education program.  This will familiarize you with provincial laws regarding personal health records, privacy and confidentiality.

Following are three links you will need to complete the PHIA online education program.

When you click the first link to start the course, you will have to register to obtain a username and password.  Information on how to do that is in the help guide (the second link).  For help with logging on, passwords, etc, please contact the Newfoundland and Labrador Centre for Health Information help desk: 1-877-752-6006 (toll free) or 709-752-6006 or by e-mail: learning@nlchi.nl.ca

A PHIA Education Program delivered by one of the Province’s Regional Health Boards would be an acceptable alternative.

Once you have successfully completed the PHIA online course or the Education Program please print the certificate and forward it to the College as proof of completion by e-mail (cpsnl@cpsnl.ca) or by fax (709-726-4725).

It is expected that newly licensed physicians complete a PHIA online course or Education Program as soon as reasonably possible, but in any event within the first two months of commencing practice.

Locum physicians should complete the PHIA online course or Education Program during their locum period.   If further locums are planned, then the PHIA online course or Education Program must be completed prior to the commencement of the subsequent locum.  The PHIA online course or Education Program must also be completed before a current locum will be extended.
